This notice applies if you are a consumer, that is, a natural person who concludes a contract for purposes that are predominantly outside your trade, business or profession. It covers paid Money Circle memberships (digital content and digital services) and follows the statutory model notice for distance contracts (Anlage 1 zu Artikel 246a § 1 Abs. 2 Satz 2 EGBGB), adapted to digital services.
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day of the conclusion of the contract.
To exercise the right of withdrawal, you must inform us (Chartviews AI F.Z.E, Premises B.C. 1302888, Ajman Free Zone C1 Building, Ajman Free Zone, Ajman, United Arab Emirates, e-mail: support@money-circle.net) of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or an e-mail). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
If you withdraw from this contract, we shall reimburse to you all payments received from you, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
If you requested that the provision of services should begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until the time you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.
Digital content that is not supplied on a tangible medium (for example course material, recordings and downloads): your right of withdrawal expires early if we have begun to perform the contract after you have expressly consented to our beginning performance before the end of the withdrawal period, and have acknowledged that, by giving that consent, you lose your right of withdrawal once performance has begun (§356(5) BGB).
Services (for example access to the platform, community, live sessions and tools): your right of withdrawal expires early if the service has been performed in full and we began performing it after you expressly consented to this and acknowledged that you lose your right of withdrawal once the service has been fully performed by us (§356(4) BGB). If you withdraw before then, you pay a proportionate amount for what has already been provided (§357a BGB).
When you buy a membership, checkout asks you for exactly this consent and acknowledgement: you tick a box to say that you want us to start providing the digital content and services immediately and that you understand how that affects your 14-day right of withdrawal: for digital content it ends once delivery has begun, for services once they have been fully provided, and if you withdraw earlier you pay a proportionate amount for what has already been provided. We record the date and time of that confirmation. Without it, we do not start the service and the purchase cannot be completed.
The 7-day Master trial ($9.99) is a paid contract like any other membership, so this notice applies to it. The withdrawal period of 14 days runs from the conclusion of the contract, that is from the trial purchase, not from the later monthly charge. The right ends early only if you gave the express consent and acknowledgement described above when you started the trial. The trial fee counts as your first payment for the 14-day money-back guarantee below. If you pay by card and do not cancel before the trial week ends, the contract continues as a monthly Master subscription; you can end it at any time on the cancellation page.
Renewal payments, including the first monthly fee after a trial, are not covered by the money-back guarantee, but you can cancel at any time so that the next renewal never happens. Your statutory right of withdrawal is not affected: if you withdraw within 14 days of ordering, we refund all payments, including the first monthly fee, less a proportionate amount for services already provided.
Separately from the statutory right described above, and in addition to it, we offer a voluntary 14-day money-back guarantee on the first payment of a plan; if you began with the trial week, the trial fee is that first payment.
